No one else is doing that,” said John Wellbank, who was appointed chief executive officer of InStar, which builds software for scheduling, monitoring, tracking and billing patients.

Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. THE MERGER of the medical software companies iSoft and Torex was thrown into confusion yesterday when the Office of Fair Tradings decision to clear the deal was overturned on appeal. The new Competition Commission Appeal Tribunal ruled that the OFTs decision- making failed to consider the full implications of the merger. It represents an important first victory for IBA, the Australian software company that is challenging the merger, which it says will mean Torex, its distributor in the UK, does not promote its software aggressively. Lawyers for both UK companies and the OFT were still studying the ruling last night, and the OFT could appeal. It is possible the judgment could limit the scope of the OFTs recently acquired powers to adjudicate on mergers and acquisitions. Sir Christopher Bellamy, the president of the tribunal, said the OFT had failed to apply a crucial test, namely whether the Competition Commission could have come up with a different ruling. Builders say the high-end second-home market started to take off about five years ago, and theres no end in sight to the trend. OTHER NEWS The authors argue that the conventional picture of UK post-war immigration, comprising successive waves of new commonwealth immigrants that fell off after 1971, is an over-simplification. In the 1950s to 1970s there was substantial emigration out of the UK and there was now a substantial inflow of returning UK citizens each year. Earlier net immigration from Ireland had turned to net emigration recently and there had always been a significant level of labour-related migration. Using data from the Labour Force Survey, the report looks at the characteristics of migrants compared with the UK-born population. Migrant experiences are more polarised than those for the population as a whole, with larger concentrations at the extremes. For example, there were proportionately more highly educated people and more relatively unskilled in the migrant population than among those born here. To some extent this reflected the fact that many enter on work permits and as students. Overall migrants wages were higher but they were concentrated at both the top and bottom of the income distribution. Migrants had higher inactivity rates than natives which, in part, probably reflects lower participation rates among women and the high number of foreign students, and meant that overall migrants were less likely to be employed. Education and English language fluency were key determinants of labour market success.

I am perpetually entertained by the disconnection between what we do and what we say we do in the chiropractic profession. If I polled chiropractors and asked if they were actively engaged in public health work in their practices, I think its safe to say that most would say “No” or “Hell, no!” First we must define public health. Herein lies the rub. In chiropractic, our perception of public health is rather narrow (since in chiropractic college our public health courses may have focused on microbes, water sanitation, pasteurization, and immunization!). Several different but acceptable definitions for “public health” can be found in various literature. But what is the true meaning of “public health,” this ethereal and rather elusive term?
The recommendations include the following: a chiropractic scope of practice encompassing patient evaluation and care for neuromusculoskeletal conditions, such as back pain, neck pain, headache, and joint sprains and strains; referral to chiropractic care through consultation with the patients primary care physician or another VHA provider; and integration of chiropractic care into the VHA in such a way that the chiropractor, the patients primary care clinician, and other VHA providers develop a collaborative treatment regimen for each patient with neuromusculoskeletal and other health problems. The committee is comprised of six chiropractors, four other health care professionals, and one public adviser. “The key here is that the VHA system is going to a primary care model system where everyone has a primary care physician and the care of the veterans is coordinated by the primary care physicians,” said American Academy of Family Physicians (AAFP) Past President Warren Jones, M.D., Ridgeland, Miss., who serves on the committee.
Andrew C. Cohen, DC, was recently elected president of the Hawaii Public Health Association (HPHA), marking the first time a doctor of chiropractic has been appointed to the HPHA board in any capacity in the associations 61-year history. “I see this as an opportunity to increase cooperation between the chiropractors in Hawaii and the public health community,” said Dr. Cohen in an e-mail interview. In addition to his duties with the HPHA, Dr. Cohen maintains a practice in Honolulu and serves as secretary of the Hawaii State Chiropractic Association. Dr. Cohen joins the ranks of other chiropractors involved with multidisciplinary, statewide organizations, including Karen Konarski-Hart, DC, DABCO, who was elected president of the Arkansas State Board of Health earlier this year, and Mitchell Haas, DC, who was recently appointed president of the Oregon Public Health Association.

The Oklahoma City Council Tuesday enacted a new ordinance aimed at preventing “ambulance chasing” attorneys from soliciting business by using police accident reports. Schwartz said Tuesday the law aims to prevent attorneys from using the reports to contact potential clients. Schwartz said his own wife was in a wreck recently and within a matter of days received five solicitation letters from various attorneys. The law, at least on the state level, does not address whether the police accident reports are public records. According to Oklahoma City Municipal Counselor William West, accident reports are not public records and are handled differently from actual public records such as city council agendas, minutes and similar documents. This means that state and local authorities can exercise some measure of control over the records, such as what may or may not be done with them once the records leave city or state custody. As part of the ordinance passed Tuesday, the council also said drivers license numbers will be redacted or wiped out on the documents that are released “to offer the public some measure of protection,” according to Schwartz. “My primary goal was to protect people,” said Schwartz, who is himself an attorney. “Theres enough advertising out there.the public knows the resources that are available to find an attorney.”

Luton airport need not apply for inclusion in that particular list, because even with a pounds 100m facelift its carpet-warehouse appearance remains the antithesis of grace and the epitome of brutish utilitarianism. Consequently, the Bedfordshire airport is also a pretty grim place in which to while away a six-hour delay, with only the chance of a rant in front of the Airline docu-soap cameras - filming the everyday story of no-frills folk - to break the boredom. The ball-on-rod rolling contact fatigue (RCF) tester (1) is an element tester which is used to evaluate the RCF properties of materials, primarily steels, for bearing applications. In order to produce test results in a reasonably short period of time, the load imposed on the steel test rods is much higher than that typically experienced in actual bearing applications. The standard test condition, set forth by Glover (2J, results in a calculated Hertzian contact stress of 5.4 GPa. This high contact stress causes plastic deformation of the test rods. In addition to the ball-on-rod RCF Tester, many other accelerated RCF test rigs use high contact stresses to reduce test time. For example, the flat washer tester is operated at a contact stress of 4.1 GPa (3), the Rolling Contact (RC) rig at 5.4 GPa (4) and the Ball on Cylinder rig at 5.9 GPa (5). While these machines and test conditions are widely used, the use of the high stress conditions have been questioned as being too high for correlation to full-scale bearing tests that are commonly in the range of 2 - 2.7 GPa (300 - 400 ksi) (6)-(8). Zwirlein and Schlicht (6) felt that tests performed at high stress levels can lead to improper conclusions on how a material will respond at lower stress levels. The deformation occurring at the higher stress levels was felt to alter the residual stress state of the material and thus, influenced the test results. Lorosch (7) felt the plastic deformation occurring at the higher stress reduced the life exponent, compared to that obtained at lower stresses. Thus, data generated at contact stresses that created plastic deformation could not be compared to that generated at lower contact stresses.

The Directorate of Health Promotion and Wellness (DHPW) at the U.S. Army Center for Health Promotion and Preventive Medicine was established in 1995 with the mission of integrating health promotion into the total Army. A dentist was assigned to the DHPW staff in 1996 to help integrate health promotion into the Army Dental Care System (ADCS). To guide the development of DHPW products, services, and policy for the ADCS, DHPW conducted a survey of dental health promotion and preventive dentistry practices within the ADCS. The survey queried the frequency with which dentists deliver such services and the type and source of their patient educational materials. In this paper, we report the findings of that survey and discuss their implications for improving the delivery of dental health promotion and preventive dentistry services in the ADCS.

However, the study also reveals that less than half (47%) of those parents/guardians go that often themselves. While the lack of dental insurance and costs for dental treatment are factors preventing adults from seeing the dentist (only 24% of adults without dental insurance see the dentist twice a year or more), the oral health of their children appears a motivating factor. Half of parents/guardians with uninsured children take their children to the dentist twice a year or more, citing preventive care as the primary reason.

After slowing in 2007, growth is projected to average below 2% in 2008, with a weak first half but some rebound thereafter, and continuing at near potential rates in 2009. Job creation will continue, albeit at a slower pace, allowing for further slight declines in the unemployment rate. Following several years of budgetary consolidation, no further improvement in the budget deficit is expected, with a reduction in both revenues and spending in relation to GDP. Available information to date, including preliminary third quarter national accounts data, points to a modest slowdown of activity for 2007 as a whole. GDP growth is likely to average 1.9%, down from 2.2% in 2006. On the domestic side, the main sources of weakening activity are private consumption and residential investment. A softening of housing construction was to be expected following consecutive years of strong growth. It is also consistent with the flattening of housing prices. However, the weakness in consumer spending in the first half of the year is more surprising, considering the acceleration of real disposable income in 2007. As a result, the household saving rate has increased substantially. On the external side, real exports and imports have both decelerated: on balance, the external sector continues to exert a drag on GDP growth.
Domestic demand exceeds expectations. * Household spending in Q1 remained above the 2005 average according to monthly data while unemployment edged down again in March. Consumer spending is likely to continue to dominate growth again this year.

OKLAHOMA CITY (AP) — Outside consultants began work this week on a $5 million computer system that has had difficulty providing timely, accurate financial and court-case information. State Auditor Clifton Scott said he has been unsuccessful in solving problems facing court clerks who began using the system in December. Oklahoma, Tulsa, Payne, Canadian, Cleveland, Comanche, Garfield and Rogers counties now are on the system. Eventually, all county court clerks are supposed to be on the system.
