Unfortunately last weekends weather forecast gave a bad report for boat fishing and consequently a lot of charter skippers cancelled the parties they had booked. Once again the weather forecasters got it wrong so charter skippers, tackle shop owners and anglers lost money and sport. There were one or two private boats out ( one was the Blue Bell II out of Amble, with Tony Urwin and his wife. Fishing just outside the harbour they had over 30 cod between 3-5lb. Private boats out of Seaham also managed to get out and, again fishing just off the harbour, they took cod to 6lb. On the subject of boats, two more charter vessels for you.

The NBERs Law and Economics Program studies the effects and causes of legal rules, with a special focus on the foundational legal subjects–property law, criminal law, contract law, and tort law–and on the operation of the legal process. In regard to the operation of the legal process, the Program examines topics such as labor markets for lawyers, litigation dynamics, judicial and agency behavior, and the determinants of legislative action. In addition, the Program studies the effects and causes of legal rules across a range of legal subjects beyond property, criminal, contract, and tort law, including corporate law, employment law, health care law, social welfare law, family law, bankruptcy law, patent and copyright law, and antitrust law. The Program meets twice per year, once at a mid-year program meeting and again at the NBERS Summer Institute. The Programs recent special activities include a project in the area of corporate governance, under the direction of Research Associate Lucian Bebchuk; selected papers from that project are scheduled to appear in a forthcoming issue of the Review of Financial Studies. In this article, I first describe recent research in the foundational legal subjects and then turn to work on the operation of the legal process. I conclude with an overview of work on the effects and causes of legal rules in corporate law, employment law, health care law, social welfare law, family law, bankruptcy law, patent and copyright law, and antitrust law. Property Law, Criminal Law, Contract Law, and Tort Law A fundamental aspect of any legal system is the structure of property rights. Recent work by Oliver Hart (13540) is the latest in an important line of papers by Hart, Sanford Grossman, and John Moore that examine the effects of a particular conception of property rights emphasizing “residual control.” In this view, the owner of an asset retains those rights to the asset that are not specifically assigned by any existing contractual commitment. While previous papers in the series have examined the effects of the residual control rights conception of property rights in the face of parties non-contractible up-front investments, the recent paper by Hart studies the effects of property rights of this form in a model with uncertainty of values and costs of a good to be traded. Harts model suggests that ex-ante contracting over asset ownership can reduce later incentives to engage in hold-up. A system that did not provide for property rights in the Grossman-Hart-Moore sense (reserving residual rights to the state rather than to the property owner) would be inferior within this framework.

Repeated evidence shows instruction by a registered dietitian (RD) is an effective weight loss strategy for various populations, different disease conditions, and in multiple settings. To determine how weight loss success due to an RD-led intervention compared with frequent weight monitoring, researchers examined a weight loss program that included RD-led weight-loss classes and frequent weigh-in visits. Investigators evaluated weight loss on a continuous scale based on attendance of both RD-led weight-loss classes and weigh-in visits that did not include RD interaction. They examined the relative strength of each of these factors on weight-loss success in a population recruited from the surrounding community for a hypocaloric weight-loss study. Eight of the participants for the hypocaloric weight loss intervention had type 1 diabetes mellitus, a condition that makes successful, safe weight loss especially difficult. The study subjects were overweight (BMI > 27.0) men (n=10) and women (n=16). At baseline the mean BMI was 33.2 to 3.67 and age was 43+12 years. Subjects with type 1 diabetes had mean baseline hemoglobin Ale (HbAlc) of 7.2% [+ or -] 1.0%. The energy prescription was determined as a 750-kcal deficit from estimated total energy expenditure. Subjects then participated in the 11-week weight-loss phase composed of 33 visits, including 11 weekly 1-hour RD-led weight loss classes and 22 semiweekly non-RD-related weigh-in visits. Weight loss (%) was evaluated on a continuous scale based on percent of RD and non-RD visits attended. Subjects with type 1 diabetes were asked to provide blood glucose records weekly and HbAlc was measured on the fist and last study visits. The 26 subjects completed the weight-loss program with an average weight loss of 3.8 [+ or -] 2.8 kg (P<0.001). There were no significant differences between sex or diabetes status in relation to weight loss, RD visit attendance, or non-RD weigh-in visit attendance. Among the subjects with type 1 diabetes, Hbalc was not statistically significantly different pre- versus post-weight loss. Weight loss (%) was significantly correlated with attendance of RD-led weight loss classes (r=0.451, P=0.021) but not weigh-in visit attendance that did not include RD-led weight loss classes (r=0.329,P=0.101). Frequent dietary instruction by an RD conveying topics related to weight loss was more effective than frequent weigh-in visits alone in promoting weight reduction in this study.

Does automobile insurer retained an attorney to defend Doe and informed the attorney that the accident was “suspicious.” The attorney then began to communicate with attorneys for the insurer about the possibility of fraud by Doe-providing them with photographs, pleadings, and discovery-but did not notify Doe of these activities. The attorney also learned that the insurer was going to sue Doe, but did not inform Doe of the insurers intent. When the insurer later filed suit against Doe, it allegedly failed to serve her with the complaint and deliberately filed for entry of a default judgment when Doe did not respond to the complaint. Doe sued the insurer and the attorney, alleging breach of the implied covenant of good faith and fair dealing, among other claims. Plaintiff asserted that the insurer did not inform her of her right to independent counsel even though it knew that its suspicions created a conflict of interest between it and plaintiff, Plaintiff also contended that defendants had engaged in the same wrongful conduct before.

BOSTON — Monopolar radiofrequency energy delivered to the eyelids through a shallow treatment tip is an effective noninvasive option for rejuvenating both upper and lower eyelid skin, Dr. Brian S. Biesman said at the annual meeting of the American Society for Laser Medicine and Surgery. Of the 72 patients treated at four medical centers, 64 underwent treatment of both upper and lower eyelids, 7 underwent upper eyelid treatment only, and 1 underwent only lower eye-lid treatment. All of the patients were evaluated at 1 hour, 1 week, 1 month, 2 months, 4 months, and 6 months after treatment. Based on physician assessment at the 6-month follow up, significant reductions in both upper eyelid hooding and skin tightening were noted in, respectively, 86% and 88% of the patients who underwent the procedure. The physicians reported lower eyelid tightening in 83% of the patients who had the procedure done. In terms of adverse events, two patients at one center sustained burns that resolved without problem, and there were no ocular injuries.

EmployAbilities found two candidates and after the interview process was
completed, Blackfoot offered employment to Paula Hogan.
Paula began her new position on December 13, 2005 as Blackfoots new mail
clerk. A job coach for EmployAbilities helped Paula to get oriented and
started on her new position duties (a job coach from EmployAbilities was
provided at no cost to Blackfoot; this is a service that EmployAbilities
